Touch Terms and Conditions

Effective Date: March 10, 2025

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING TOUCH.

These Terms and Conditions ("Terms") govern your use of Touch ("App"), a mobile application that provides football juggling tracking, progression, and training features. By using the App, you ("User" or "You") agree to be bound by these Terms.

Introduction

Use of Touch implies acceptance of these Terms. If you do not agree, do not use the App.

1. Service Scope

Touch provides:

  • Real-time juggling counter: On-device pose detection to count juggles.
  • Tier-based progression: Tiers that reflect your skill level and progress.
  • Weekly challenges: Challenges to complete each week.
  • Weekly coaching tips: Tips and guidance to improve ball control.
  • Streak tracking: Tracking of consecutive practice days.
  • Foot split analytics: Left foot and right foot kick counts.

Touch is a sports training aid. It is not a medical device, fitness tracker, or health application. It does not provide medical, fitness, or injury-prevention advice.

2. No Medical or Health Claims

Touch does not provide medical advice, fitness advice, injury prevention guidance, or health assessments. The App is a training aid only. You should consult a qualified professional before beginning any new physical activity, especially if you have health concerns.

3. Physical Activity Disclaimer

Juggling a football is a physical activity. Touch is not responsible for any physical injury, strain, or accident that occurs during use of the App or during juggling practice. You (and, if you are under 18, your parent or guardian) accept all physical risk. Use the App and practice juggling at your own risk.

4. Camera Permission

You must grant camera access for the App to function. The camera is used solely for on-device pose detection to count juggles. Revoking camera permission disables core functionality. Touch does not record or store any footage. You agree not to use the camera feature in situations that would violate the privacy of others.

5. Minors

The App is designed for users aged 14–17 and older. Users under 13 are prohibited from using Touch. Users aged 13–17 should have parental or guardian awareness before using the App. Parents or guardians of minor users may contact Touch to request data deletion on behalf of their child.

6. Subscription & Payments

  • Subscriptions are billed through the Apple App Store and are subject to change.
  • No free trial unless explicitly offered through the App Store.
  • Cancellation takes effect at the end of the current billing period. Access continues until the period end; we do not revoke access immediately upon cancellation.
  • Refunds are handled exclusively by Apple. Touch does not issue refunds directly.

7. Honor-Based Challenge Completion

Some weekly challenges are self-reported and completed on an honor basis. Touch does not verify completion of honor-based challenges. You agree not to falsely mark challenges as complete.

8. Intellectual Property

  • Touch owns the App, tier system design, challenge library, coaching tip library, badge designs, and all proprietary content.
  • You own your personal session data.
  • You may not reverse engineer, scrape, or redistribute App content.

9. Account Termination

Touch may suspend or terminate your account for abuse, fake data manipulation, or violation of these Terms. Upon termination, data stored in Supabase may be retained for a reasonable period for legal compliance and then deleted.

10. Liability Limitations

Touch is not liable for:

  • Physical injury during juggling sessions or use of the App.
  • Inaccurate juggle counts due to environmental factors (e.g. lighting, camera angle, obstructions).
  • Loss of streak data or other data due to technical error.
  • Inability to complete challenges for any reason.

Juggle counting is provided as a best-effort tracking tool, not a guaranteed precise measurement. Touch is not liable for any decisions or outcomes based on counts or other in-App data.

11. App Store Compliance

Use of the App is subject to Apple's App Store Terms of Service. Apple is a third-party beneficiary of these Terms with the right to enforce them against you.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which the developer operates.

13. Changes to Terms

Touch may update these Terms at any time. Continued use after changes constitutes acceptance. We will notify you of significant changes via email or through the App.

Touch does not use AI in the application today. If AI is introduced in the future, users will be notified. By using Touch, you accept these Terms and the limitations and responsibilities described above. You use the App at your own risk.
